Now that the New Year has come and gone, your deadlines to closing are fast approaching.  It is imperative that you contact your closing agent and lender to confirm whether they need any additional information from you in order to be ready to close on the closing date.

I have found that buyers aren’t prepared to submit all of the necessary documentation to a lender when applying for financing.  It is important for a buyer to have all of their documentation in order when they are going to apply for financing, because much of the documentation is not readily available  for example..

  • W-2’s
  • Paystubs,
  • Recent bank statements,
  • Income tax returns,
  • Self- employed buyers may have to submit a current-year profit-and-loss statement

Documents expire after 60 days, if you take a long time house-hunting, provide the most current paycheck, bank statements.

Look Around For The Right Mortgage

Additionally, I’ve found that buyers do not get quotes from more than one lender, or if they get a quote, it’s not a “real” quote, because they haven’t submitted all of their necessary documentation to find out what loan program they actually qualify for.  Buyers seem to forget that they are buying the most expensive thing they will ever own, and while they will shop at 2 or 3 stores for a bargain on a pair of jeans, they won’t shop at 2 or 3 lenders for the lowest priced loan.

So in sum, buyers need to be prepared to apply for financing, and they need to get more than one quote for interest rates.

Make Sure That You Are Legally Covered

Miami Beach Buyers and Sellers please make sure that all of your permits are covered when you are in the process of selling or purchasing a home. Permits can become a very expensive unknown real estate expense.  The “AS IS” form purchase contract provides that the seller is obligated to help the buyer in closing out any permits, but is not obligated to spend any money in helping the buyer close out any permits, while the Residential Contract for Purchase and Sale provides that a certain percentage of the purchase price (this amount is negotiated, but the default amount is 1.5% of the purchase price) is to be allocated to re-mediate any open or expired permits.

Dear Miami Beach Seller,

In a perfect world when you are involved in a real estate closing, your real estate agent, your attorney (if you have one, and I recommend that you do), and the closing agent will take care of all of the details and your only job is to show up to closing.  However, as perfect as it is living on South Beach, you know we don’t live in a perfect world, and you can use the following list as a guide to help make sure that a closing is not delayed:

Ensure a smooth Real Estate Closing

  1. If you are a foreign-national, then you need to find out whether the Foreign Investment In Real Property Tax Act (FIRPTA) applies to your transaction as soon as possible (even prior to signing the contract if possible).  If it does, then you need to find a Certified Public Accountant who can provide you with tax advice to guide you through the best method for you to address the FIRTPA requirements.
  2. If the owner of the property is an entity (i.e. a limited liability company, corporation, limited partnership, etc.), then you need to address the following:
    1. Make sure that you have the following documents ready for closing:

i.      A recent Certificate of Good Standing from the state in which the entity is incorporated.

ii.      A certified copy of the filed formation documents.

iii.      A certified copy of the governing documents (i.e. the Operating Agreement, Shareholders Agreement, Partnership Agreement, etc.).

  1. Confirm who has the authority to sign the closing documents on behalf of the entity, and make sure that person(s) is/are available to sign the closing documents at closing, or if you will need to give authority to another person to sign on behalf of the entity.
  2. If the owner of the property is a trust, then you need to address the following:
    1. Make sure that you have a copy of the Trust Agreement.
    2. Confirm who has the authority to sign the closing documents on behalf of the Trust, and make sure that person(s) is/are available to sign the closing documents at closing.
  3. Be as involved with the closing process as necessary.  This means that you should speak to your attorney (or the closing agent if you don’t have an attorney) on a regular basis to make sure that everything is moving forward in a timely manner.
  4. Make sure that your attorney (or the closing agent if you don’t have one) has your wiring information.  Keep in mind that the name on your bank account must match the name of the seller.
  5. If you are not going to be able to attend the closing, make sure that you have signed a Power of Attorney for any documents that need to be signed at closing.

Following the above steps will help ensure that the closing will not be delayed due to any items that are the seller’s responsibility.
